Have been deer hunting many times each
season since 1975, and using climbing stands since 1976. Since 1984 have hunted primarily in Alabama,
whose deer season begins around October 15 each year and runs to the end of January.

Introductory materials
BACKGROUND INFORMATION ON DEER HUNTING FROM
ELEVATED STANDS
1)
At the risk of boring the court with
information already known, as an expert I am providing a brief synopsis of deer
hunting from elevated stands.
a.
Deer hunting is a very popular sport and a
multi-million dollar commercial industry.
b.
In the USA, deer hunting season begins in
the fall and varies from as short as a one-week gun season to several
months.
c.
Deer can be legally hunted with bow and
arrow, with modern firearms, and with muzzle-loading black powder firearms (and
with spears in Alabama).
d.
Prior to the 1970’s, hunters who wished to
hunt from elevated stands primarily built free-standing towers (called shooting
houses) or more popularly, built platforms in trees accessible via ladders,
steps nailed to the tree, or occasionally some other means.
e.
In the 1970’s, the Baker Company
(Valdosta, GA) (accessed on 6-11 from: http://www.ehow.com/about_4843821_deer-stands.html)
developed a “climbing” portable tree stand that immediately changed elevated
deer hunting. A Baker stand could be
readily transported to the hunting location and attached to the tree. By
“hugging” the tree the hunter could lift his feet thereby lifting the stand
attached to his feet with loops and climb a limbless tree.
f.
Soon an entire industry formed around several
types of portable tree stands, tree stand accessories, and other variations
including ladder stands, commercial shooting houses, tripod stands, etc. More recently, associated equipment such as
waist belts, chest harnesses and full-body fall arrest harnesses, as well as
ascent and descent tie-in devices were commercially promoted.
g.
Deer
hunting is typically done from just before sunrise to just after sunset; so
many hunters will begin their hunt or end their hunt in darkness (as verified
in NBEF video).
h.
Deer
hunters typically hunt regardless of weather conditions. That is, hunters may
hunt during rain, snowfall, high winds, extreme cold, or hot and humid weather.
i.
Some
hunters can be expected to be in poor physical condition, over-weight, very
young and very old, with varying degrees of hunting, tree stand, and safety
harness (Full Body Harness, FBH) experience.
j.
Most
hunting from elevated stands is done alone, and may be done out of cell phone
range.
2)
Dr. Eric Jones and I in 2012 published
survey of deer hunting safety. Over 1000
deer hunters have responded. Note that these were self-reported data which
suggests the possibility that these responses are biased towards positive
responses to an unknown degree. Pertinent
results include:
a.
With regard to more than 700 Hunter
Education Instructors:
i.
In question #10, 104 of 732 Hunter
Education Instructors (14%) reported using a safety device (FBH, belt, etc.)
less than 10% of the time.
ii.
In question #19, 300 of 727 Hunter
Education Instructors (41%) reported wearing a harness less than 10% of the
time while ascending; whilst 362 of 727 respondents (50%) reported wearing it
more than 50% of the time.
iii.
Of those Hunter Education Instructors who
do NOT use a safety device (question #12), 57 of 234 respondents (24%) reported
that, “harnesses are too much trouble”.
iv.
In question #26, 194 of 728 respondents
(26%) answered “no” to “Do you always make sure the tree stand you purchase has
TMA approval”.
b.
Of the more than 300 deer hunter
“consumers” respondents:
i.
In
question #10, 110 of 348 respondents (31%) reported using a safety device (FBH,
belt, etc.) less than 10% of the time.
ii.
In question #19, 229 of 340 respondents
(67%) reported wearing a harness less than 10% of time while ascending; whilst
86 of 340 respondents (25%) reported using harness whilst climbing more than
50% of the time.
iii.
Of those “consumers” who do NOT use a
safety device (question #12), 35 of 167 respondents (21%) reported that,
“harnesses are too much trouble”.
c.
Keep in mind that survey responses are
self-reported data. It could be expected
that ALL respondents would exaggerate somewhat their positive safety and other
behaviors, but Hunter Education Instructors might feel even more pressure to do
so. Therefore, I would suggest that these data are at least somewhat inflated
towards positive (safer) behavior.
3)
In summary of this section, these points
suggest that:
a.
Deer hunting can on occasion be a
dangerous sport and that a major risk is falling from a treestand or being
injured by a fall arrest device.
